Tips On How To Deal With Illegal Content Scrapers
I discovered that some scum-sucking pile of worm--sorry, this issue has me hot under the collar! My content was being scraped by an automatic scraper bot and was being posted to another website WITHOUT proper credit given and WITHOUT my permission. I contacted the offending site\\\'s webhost, and here\\\'s what I had to do to get the situation resolved:
A. Since intellectual property is being stolen, this is a legal matter and the offending site\\\'s webhost will require a DMCA notice to be filed via fax or letter. This cannot be done online.
B. The DMCA Notice must have certain information and certain verbiage in it to fulfill legal requirements.
1. Identify in sufficient detail the copyrighted work that you believe has been infringed upon or other information sufficient to specify the copyrighted work being infringed (for example, \\\"The copyrighted work at issue is “Intellectual Property: Valuation, Exploitation, and Infringement Damages” by Gordon V. Smith, published by Wiley, ISBN #047168323X\\\").
2. Identify the material that you claim is infringing the copyrighted work listed in item #1 above. You must identify each web page that allegedly contains infringing material. This requires you to provide the URL for each allegedly infringing result, document, or item.
3. Provide information reasonably sufficient to allow the webhost to contact you.
4. Provide information, if possible, sufficient to allow notification to the owner/administrator of the allegedly infringing webpage or other content (email address is preferred).
5. Include the following statement: \\\"I have a good faith belief that use of the copyrighted materials described above as allegedly infringing is not authorized by the copyright owner, its agent, or the law.\\\"
6. Include the following statement: \\\"I swear, under penalty of perjury, that the information in the notification is accurate and that I am the copyright owner or am authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.\\\"
7. Sign the paper.
You will need the postal mail address or the fax number of the Abuse Department of the offending site\\\\\\\'s webhost. Mail or fax the document to them and be available when they contact you.
